DMCA / Copyright Policy
MyUpload respects the intellectual property rights of others and expects users of https://myupload.us (the "Service") to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
1. Filing a DMCA Takedown Notice
If you believe content available on the Service infringes your copyright, use the "Report" link on the page where the content appears and select "Copyright" as the reason. If you have an account, you may also open a support ticket. Your notice must include:
- Your signature (typed name is sufficient) as the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or a representative list, if multiple works are covered by one notice).
- Identification of the material claimed to be infringing, with enough detail (e.g., the specific URL) to allow us to locate it.
- Your contact information: name and email address.
- A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
Notices that do not substantially comply with the above requirements may not receive a response.
2. Our Response to Valid Notices
Upon receipt of a compliant notice, we will:
- Remove or disable access to the identified material.
- Notify the user who uploaded the material and provide them with a copy of the notice.
- Track the incident against the uploading account under our repeat-infringer policy.
3. Counter-Notification
If you believe your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice by opening a support ticket that includes:
- Your signature (typed name is sufficient).
- Identification of the material removed and its location before removal.
- A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification.
- Your name and contact information, and a statement that you consent to the jurisdiction of the applicable United States federal court and that you will accept service of process from the person who filed the original takedown notice.
Upon receipt of a valid counter-notice, we will forward it to the original complaining party. If we do not receive notice that the complaining party has filed a court action within 10–14 business days, we may restore the material.
4. Repeat Infringer Policy
Accounts that receive three (3) valid copyright strikes will be suspended or permanently terminated, consistent with our Terms of Service.
5. False Claims
Submitting a false DMCA notice or counter-notice may expose you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).
