Terms of Service

Welcome to MyUpload ("MyUpload," "we," "us," or "our"), available at https://myupload.us. These Terms of Service ("Terms") govern your access to and use of our video streaming, file hosting, and link shortening services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to create an account or use the Service. By registering, you represent that you meet this requirement.

2. Your Account

  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • One person or entity may not maintain multiple accounts to abuse referral, earnings, or quota systems.
  • We may suspend or terminate accounts that violate these Terms, at our discretion.

3. Content You Upload

You retain ownership of content you upload. By uploading, you grant MyUpload a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and transmit your content solely for the purpose of operating and providing the Service (e.g., streaming, serving downloads, generating shortened links).

You are solely responsible for the content you upload and represent that:

  • You own the content or have all necessary rights and licenses to upload and distribute it.
  • Your content does not infringe any third party's copyright, trademark, privacy, publicity, or other rights.
  • Your content complies with these Terms and applicable law.

4. Adult Content Policy

MyUpload permits sexually explicit or adult content only where every person depicted is a consenting adult (18 years or older at the time of creation). If you upload such content, you represent and warrant that:

  • Every person appearing in the content was 18 or older when the content was created.
  • You have obtained and retain documented proof of age and consent for every person depicted, and you will produce it upon request.
  • You hold the distribution rights necessary to upload and share the content on MyUpload.

Zero tolerance: Content depicting minors, or depicting non-consensual acts, is strictly prohibited. We will immediately remove such content, permanently terminate the uploading account, preserve evidence, and report the matter to the National Center for Missing & Exploited Children (NCMEC) and/or law enforcement as required by law.

Video streaming pages may display a mix of mainstream and adult advertising. Direct-download and link-shortener pages display mainstream advertising only.

5. Prohibited Content and Conduct

In addition to Section 4, you may not upload, share, or link to content that:

  • Infringes copyright, trademark, or other intellectual property rights (see our DMCA / Copyright Policy).
  • Is malware, a virus, or otherwise designed to damage or gain unauthorized access to a system.
  • Is unlawful, defamatory, harassing, or violates a third party's privacy or publicity rights.
  • Constitutes spam, or is used to artificially inflate views, downloads, clicks, referrals, or earnings.
  • Violates any applicable law.

6. Reporting and Enforcement

Anyone — including users without an account — can report content using the "Report" tool available on the page where it appears. We review reports and may remove content, issue a strike, and/or suspend or terminate the associated account.

Repeat-infringer policy: Accounts that accumulate three (3) strikes for violations of these Terms (including copyright infringement) will be suspended or permanently terminated, at our discretion.

7. Premium Plans, Earnings, and Payouts

  • Premium plans are arranged directly with our support team via a support ticket; there is no automated checkout, and plan assignment, pricing, and any refunds are handled manually and at our discretion.
  • Users who upload content may earn revenue from views, downloads, or link clicks, subject to the rates and terms displayed in your account dashboard, which may change at any time.
  • Payouts are processed manually to the payout method and details you provide (e.g., PayPal, bank, or crypto). You are responsible for the accuracy of this information; we are not liable for funds lost due to incorrect details.
  • We may withhold, delay, reverse, or deny payouts in cases of suspected fraud, chargebacks, policy violations, or invalid/fraudulent traffic, and may deduct amounts already paid out in such cases.
  • Minimum payout thresholds and processing timelines are as displayed in your account dashboard and may change at any time.

8. Advertising

The Service is supported by advertising. Advertisements may be served by us or by third-party ad networks, which may use cookies or similar technologies. See our Privacy Policy for details.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including for violation of these Terms. You may stop using the Service and request account closure at any time by opening a support ticket from your dashboard.

10. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee uninterrupted, secure, or error-free operation of the Service, and we are not responsible for content uploaded by users.

11. Limitation of Liability

To the maximum extent permitted by law, MyUpload and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service.

12. Indemnification

You agree to indemnify and hold MyUpload harmless from any claims, damages, liabilities, and expenses (including legal fees) arising from your content, your use of the Service, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles.
